    Regulations of the online store "HASIK DESIGN"

    § 1 General Provisions

    This regulation defines the rules of operation of the "HASIK DESIGN" online store operated by HASIK DESIGN STUDIO GRZEGORZ HASIK TOMASZ KRZYŻANOWSKI S.C, hereinafter referred to as the Seller„.

    1. Contact with the Seller is possible:

    2. All terms and concepts used in the Regulations have the following meanings:

    • "TERMS"– these Regulations;

    • "CUSTOMER"– an individual, legal entity, or organizational unit without legal personality but with legal capacity, placing an Order in the Online Store;

    • "CONSUMER CUSTOMER" an individual acting within their business activity but unrelated to its professional nature, with a registered office or place of delivery in Poland;

    • "CONSUMER"– a Customer who is a natural person, using the Store for private purposes;

    • "PRODUCT"– a movable item available in the Online Store, subject to the Sales Agreement;

    • "SALES AGREEMENT (AGREEMENT)"– a sales agreement for goods under the Civil Code concluded between the Seller and the Customer through the Online Store website;

    • "ONLINE STORE (STORE)"– the website available at https://hasik.design, enabling the Customer to place Orders;

    • "ORDER"– a clear expression of the Customer's will specifying the type and quantity of Goods, aimed at concluding a Sales Agreement.

    3. The aim of the Store is to sell products presented on its website and enable Customers to place Orders for these products through the website.

    4. Sales are made online between the Buyer and the Seller. Every Customer making purchases in the Store is obliged to familiarize themselves with the content of these Regulations.

    § 2 Conditions of Ordering and Warranty

    1. Placing Orders in the Store does not require registration or logging in. The Customer must fill out an online form, providing necessary information for identification and to start the implementation of the Agreement (name, email address, phone number, optionally delivery address). By placing an Order, the Customer consents to the processing of their personal data for the purpose of order fulfillment. To receive the product, the Customer must provide their delivery address.

    2. The order processing time depends on the type of product and may take up to 8 weeks.

    3. The warranty for products is 12 months from the date of purchase. The warranty does not cover elements subject to normal wear and tear (bulbs).

    § 3 Product price, payment methods and delivery

    1. Product prices provided for each of them apply at the time of placing the Order by the Customer and include VAT.

    2. Free delivery cost Orders to EU countries are delivered within 3 to 7 business days. To countries outside the EU from 2 to 8 weeks.

    3. Accepted payment methods for Products are:

    • traditional bank transfer;

    • electronic payments via Paynow oraz Paypal.

    4. Order fulfillment begins after the Customer makes the payment.

    § 4 Claims and Complaints

    1. The Store undertakes to deliver the Goods without defects and fulfill services in accordance with the concluded Agreement. In the event of defects in the delivered Goods, the Customer may use the warranty or rights arising from liability for non-conformity, at their choice. These rights are independent of each other.

    2. In the case of contracts concluded with Consumers and Entrepreneurs with consumer rights, the Store is liable for warranty and/or contractual liability for services provided for a period of 2 years from the date of issuance of the Goods.

    3. If the Customer discovers defects in the delivered Product or services, they can file a complaint, document irregularities, and express their expectations regarding repair or replacement.

    4. A complaint can be filed electronically or in writing to the Store's address.

    5. The Store processes complaints promptly but no later than 14 days from the date of receipt. The Customer is informed about the results of the complaint in writing or electronically.

    6. In the event of a dispute about the justification for refusing a complaint, the Customer who is a Consumer has the right to use alternative dispute resolution methods, such as mediation or arbitration.

    7. The customer may request repair, replacement, price reduction or withdrawal from the contract depending on the circumstances.

    8. The Store covers the transport costs of the complained Goods under the warranty, determining the delivery method.

    9. The Store does not accept returned shipments sent cash on delivery.

    10. If the Customer decides to withdraw from the contract, he will receive a refund for the product immediately, no later than within 14 days of being informed about the positive consideration of the complaint. The payment is refunded to the bank account from which the payment was made, unless the Customer clearly specifies a different method of refund.

    11. The Store reserves the right to withhold the refund until receiving the returned Goods or providing proof of its return by the Customer, whichever occurs earlier.

    § 5 Right to Withdraw from the Contract

    1. A Customer who is a Consumer or entitled to consumer rights has the right to withdraw from the contract without giving a reason within 14 days of receiving the item. To exercise this right, the Customer should contact in writing or by email at contact@hasik.designand then return the Goods to the Store.

    2. The Goods must be returned in an unchanged and complete condition, without signs of use unless the change was necessary to determine its nature, characteristics, and functions. The Customer is responsible for the reduced value of the item resulting from using it in a way exceeding ordinary use.

    3. The right to withdraw from the contract does not apply to goods:

    • non-prefabricated, manufactured according to the customer's specifications or adapted to his individual needs;

    • inextricably linked with other things by their nature.

    4. The returned Goods should be sent within 14 days of withdrawing from the contract with a statement of withdrawal to the Store. Delivery costs are not refunded. The payment is refunded to the bank account from which the payment was made, unless the Customer clearly specifies a different method of refund.

    § 6 Personal Data Protection

    1. Provisions regarding the protection of Customers' personal data by the Seller are available in the Privacy Policy on the Store's website under the „Polityka prywatności”.

    2. By making a purchase, the Customer accepts the privacy policy.

    § 7 Final Provisions

    1. Each Customer receives an invoice or another settlement document in accordance with tax regulations. VAT invoices are delivered electronically to the email address provided by the Customer or traditionally with the delivery of the goods. Acceptance of the Regulations also means consent to receive invoices electronically.

    2. These Regulations are subject to Polish law and will be interpreted accordingly. It does not limit any rights of the Customer arising from applicable laws in their country of residence.

    3. The Seller reserves the right to change the Regulations by announcing changes on the Store's website. Changes come into effect 14 days after the date of publication on the website. Orders placed before the effective date of the changes will be processed based on the existing Regulations.
